TERMS AND CONDITIONS
BIKE RENTAL


1. Object

1.1 These general conditions govern the rental of a bicycle, concluded between the company LA VALLEE VERTE, hereinafter referred to as “the Renter” and the subscriber to the rental contract, hereinafter referred to as “the Renter”.
1.2 Any rental implies prior acceptance of these general conditions.
1.3 The customer acknowledges having read these general conditions and expressly declares to accept them without reservation.
1.4 The customer has the option of saving or editing these general conditions, it being specified that they may be subject to modifications. In this case, the applicable general conditions will be those in force:
– in the event of a reservation: at the time the tenant makes their reservation,
– in the event of immediate provision of the equipment: on the date fixed in the rental contract.
1.5 The customer declares that he has full legal capacity allowing him to commit to the contract.

2 - Conditions required to rent

2.1 The lessor reserves the right to make the rental subject to the presentation of a document proving the identity of the lessee, a copy of which may be kept.
2.2 The tenant declares that he is suitable for cycling and has no medical contraindications. He undertakes not to use the bicycle beyond its capabilities. The lessor cannot be held responsible for damage due to the incapacity of the tenant.

3 - Reservation

3.1 The lessor will confirm to the customer the acceptance of his reservation by sending a confirmation message to the e-mail address that the latter has communicated or by signing a delivery slip on his part. The rental contract will only be concluded once both parties have signed it.
3.2 The rental company reserves the right to refuse or cancel any reservation:
– to any person who does not meet the conditions required to rent,
– to any person unable to pay the security deposit referred to in the provisions of Article 11 hereof, in the event of unavailability of the requested equipment.
3.3 The information indicated by the tenant when entering the information inherent to his reservation binds him. The rental company cannot be held responsible for entry errors made by the customer and their consequences, in particular delivery delays or the impossibility of delivery that these errors could cause.

4 - Withdrawal

4.1 In the event of distance selling, the customer has 14 days from receipt of the reservation confirmation email to exercise their right of withdrawal.
4.2 This right of withdrawal can no longer be exercised if the customer has taken possession of the equipment.
4.3 Any request for withdrawal must be notified to the lessor directly to:

4.4 The refund will be made within a maximum period of 14 days from receipt of the withdrawal request.

5 - Cancellation and modification

5.1 The tenant has the right to cancel his reservation, outside the legal withdrawal period, under the following conditions:
– Up to 15 days before the scheduled possession of the equipment: the price paid when booking is fully refunded;
– Between 7 and 15 days before the planned possession of the equipment: the price paid when booking is refunded up to 50%;
– Between 3 and 7 days before the planned possession of the equipment: the price paid when booking is refunded up to 25%;
– Less than 3 days before the scheduled possession of the equipment: the price paid at the time of reservation is retained in full by the rental company.
5.2 Any refund will be made within a maximum period of 14 days from receipt of the cancellation request to the address lavalleeverte09@gmail.com
5.3 The tenant has the right to modify his reservation, free of charge, subject to informing the rental company at least 48 hours before the start of the rental day. The tenant acknowledges in this regard that new rental prices may apply in particular depending on the date, duration and equipment chosen.

6 - Effective date and duration of the contract

6.1 The rental contract takes effect upon the actual provision of the equipment, after full payment
6.2 The risks are transferred when the bicycle and any accessories are handed over to the tenant, who will assume custody of them under his or her entire responsibility.
6.3 The rental and custody of the equipment ends upon actual delivery of all the equipment rented to the agency.

7 - Eviction of the lessor

7.1 The rented equipment remains the exclusive property of the seller.
7.2 The equipment cannot be transferred or given as a guarantee.
7.3 The customer undertakes, in general, not to grant any rights with regard to the equipment for the benefit of anyone, likely to affect the enjoyment of it or to limit its availability or the full ownership of the lessor.

8 - Loan and sublease

8.1 The bicycle and any accessories can only be used by the signatory of the contract, who undertakes not to lend them.
8.2 Subletting of equipment is strictly prohibited.

9 - Price and payment

9.1 Rental rates are displayed in the rental agency and on the la-vallee-verte.fr website, they are determined according to the rental duration chosen.
9.2 The entire service is paid for by the tenant under the following conditions:
– in the event of immediate provision of the equipment: at the time of conclusion of the rental contract,
– in case of reservation: at the time of reservation.
9.3 Accepted payment methods are: credit card and cash.

10 - Security deposit

10.1 In all cases, when signing the contract, a security deposit by credit card imprint will be requested from the tenant upon simple request. The security deposit amount is not collected on this date. It will only be collected in the event of failure to fulfill an obligation in these general rental conditions noted upon return of the rented equipment. The security deposit will be released at the end of your Rental Agreement if there are no additional costs.
10.2 It is expressly agreed that the amount of the security deposit does not in any way constitute a limit of liability.

11 - Provision

11.1 In the event of no bicycles available, the rental company reserves the right to refuse any rental request.
11.2 The lessor cannot be held responsible for any delays in availability or delivery, due to any reason beyond its control nor for their direct or indirect consequences. He is not liable for any compensation in this respect.
11.3 The tenant acknowledges having been personally invited to check the equipment when it was made available. Any reservations about the condition of the equipment must be indicated on the contract when it is signed. In the absence of reservations, the bicycle as well as any accessories entrusted to it are deemed to be in perfect working and maintained condition.

12 - Use

12.1 The tenant is required to wear clothing suitable for cycling. Wearing a helmet is strongly recommended by the rental company and is obligatory for children under 12 years old and provided when renting bicycles. The rental company declines all responsibility in the event of non-use of the safety elements.
12.2 The tenant is authorized to freely use the bicycle, provided that he uses it reasonably and in accordance with its intended purpose, which excludes in particular:
– its use on terrain or in conditions likely to damage the bicycle,
– any use that could endanger the user or third parties,
– any dismantling or any attempt to dismantle all or part of the bicycle.
12.3 The tenant does not use the bicycle for competitions.
12.4 The tenant undertakes to use the rented item with caution.
12.5 The tenant undertakes to scrupulously respect the highway code. It is strictly forbidden to use the bicycle under the influence of drugs or alcohol, or for illicit purposes.
12.6 In general, the tenant undertakes to comply with all legal and regulatory obligations in force.
12.7 The tenant is prohibited from:
– modify the cycle as well as its accessories and/or carry out repairs,
– to transport a passenger, with the exception of a young child, provided that they are seated in an approved seat.
12.8 When parking the equipment on public roads, the tenant undertakes to systematically attach the frame and rear wheel of his bicycle to a fixed support (barrier type), with an anti-theft device.

13 - Maintenance

13.1 Costs related to normal wear and tear are the responsibility of the lessor.
13.2 Maintenance of the bicycle is the responsibility of the tenant for the entire duration of the contract. By maintenance we mean any intervention that does not require the replacement of a part (e.g.: inflating tires, tightening screws, etc.).

14 - Repair

14.1 In the event of a need for repairs during the rental, the tenant must:
– immediately stop using the equipment,
– notify the lessor immediately (and, in any case, within a maximum of 24 hours),
– do not carry out repairs on the bicycle yourself,
– do not have repairs carried out by a third party,
– pay for the parts and labor necessary for the repair (excluding repairs linked to normal wear and tear).
14.2 Only the lessor is able to judge whether a repair:
– falls under maintenance due to normal wear and tear of the bicycle and is therefore the responsibility of the rental company,
– or if the repair is due to damage suffered by the equipment during the rental and is therefore the responsibility of the tenant.
14.3 The tenant cannot claim damages for disturbance of enjoyment or immobilization of the bicycle in the event of repair.

15 - Return of the bike

15.1 The bicycle must be returned by the tenant to the same rental point, on the contractual expiry date. If the tenant wishes to extend the rental, a new contract must be established in the agency. Any late return will be invoiced (Half-day rate X number of half-days late).
15.2 The tenant undertakes to return the equipment (bike and any accessories) in the same condition as that in which he found it, in good maintenance and working order. In the event of return of equipment in poor condition, the tenant will have to pay the amount of the repair. For safety reasons, the tenant undertakes to notify the rental company of any impacts suffered by the helmets.
15.3 The rented equipment must be returned in good clean condition. Otherwise, cleaning may be charged (10 euros).

16 - Termination

16.1 In the event of non-performance by one of the parties of its contractual obligations, the other party is entitled to terminate the rental contract at any time, without notice or compensation.
16.2 The tenant must immediately return the bicycle and any accessories to the rental company, in good repair and working order.
16.3 Until returned, the customer remains responsible for the equipment in his possession and for the obligations incumbent upon him hereunder.

17 - Responsibilities

17.1 The tenant bears the consequences of violations of the highway code or any other regulations in force which are attributable to him and will reimburse the rental company for any costs of this nature that may be paid in his place.
17.2 He is responsible for damage to the equipment and/or bodily injury or material damage caused during the use of the rented equipment in his care, resulting from his clumsiness, negligence, fault or linked to use. improper.
17.3 In the event of theft, a declaration to the police or gendarmerie must be made by the tenant within 24 hours and the lessor must be immediately notified. If the tenant justifies a complaint, the lessor will issue an invoice, for an amount equal to the new value of a bicycle with the same technical characteristics, in the name of the tenant, so that he can use his insurance . The amount will be returned to the tenant if the bike is found in good working order, less any repairs. If the tenant does not justify filing a complaint, payment equal to the new value of a bicycle with the same technical characteristics will be due immediately. Failing this, the lessor reserves the right to take any action, including legal action, to obtain payment.
17.4 In the event of theft by the tenant, the lessor reserves the right to file a complaint with the competent authorities and to take any legal action against the tenant, in order to obtain compensation for their damage.
17.5 The lessor is required to guarantee hidden defects in the rented equipment.

18 - Insurance

18.1 The tenant declares having taken out individual civil liability insurance, and undertakes to present a certificate upon first request.
18.2 This insurance may be incurred in the event of theft, loss, damage and for all damage that the tenant may cause during the use and possession of the bicycle, until the bicycle is returned. -this at the rental point.
18.3 The lessor is insured for his professional civil liability with the insurance company: VYV Conseil insured by GENERALI. Upon simple request, an insurance certificate will be given to the tenant.

19 - Dispute resolution

19.1 This rental contract (specific provisions and general provisions) is subject to French law.
19.2 After an attempt at an amicable settlement with the lessor has failed, the tenant has the right to use the service of the CM2C mediator free of charge.

19.3 If the tenant has rented the equipment as a trader, disputes between the tenant and the lessor will be subject to the jurisdiction of the Commercial Court of the city of FOIX (09000).

20 - Protection of personal data

20.1 The micro-enterprise “La Vallée Verte” collects data from its customers with the aim of creating their account, managing and monitoring the relationship, and providing the service.
20.2 Customers have a right of access, rectification and opposition to data concerning them, which can be exercised by writing to the company La Vallée Verte, at the following address: LA VALLÉE VERTE , 4 LAS FEYCHOS 09000 GANAC, and attaching a copy of proof of identity.

TERMS AND CONDITIONS
EQUIPMENT RENTAL


  • The micro-enterprise La Vallée Verte declines all responsibility in the event of an accident that may occur with the rented equipment.

  • The equipment is in good condition and suitable for normal use.

  • The customer is the sole judge of his ability to use this equipment.

  • The rented equipment is placed under the responsibility of the customer as soon as he takes possession of it. He must take care of the equipment and ensure normal use during the rental period.

  • The customer does not benefit from any coverage for all damage suffered by the rented equipment and is personally liable for civil and personal liability.

  • Damaged (other than normal wear and tear), broken, lost or stolen equipment will be invoiced at the new price.

  • The equipment must be left clean.

  • Equipment returned dirty will be invoiced with a cleaning fee of 5 euros

  • When signing the contract, a security deposit by credit card imprint will be requested from the tenant upon simple request. The security deposit amount is not collected on this date.   • Identification must be presented when renting equipment.

  • Rentals must be paid in advance and are non-refundable.
